The Model Regulatory Powers were developed in response to recommendation 6 of the Building Confidence Report (BCR). The recommendation called for jurisdictions to have a broad suite of powers to monitor buildings and building work as the basis for strong compliance and enforcement action. The Model Regulatory Powers set out the minimum list of powers for jurisdictions to draw on to enforce compliance with building regulations.

The Model Regulatory Powers were agreed by the ABCB in September 2020, noted by Building Ministers in November 2020, and provided to State and Territory Governments in December 2020 for their consideration and implementation when reviewing regulatory powers in their jurisdiction.
